Who we are

Mary Molloy Solicitors is an Irish law firm founded in 1981 and regulated by the Law Society of Ireland. The firm practises from the Ormond Building on Ormond Quay in Dublin 7 and from Rose Inn Street in Kilkenny, and acts for clients in every county.

Our medical negligence work is led by Richard O'Shea, solicitor and partner. Richard takes the first call himself, runs the investigation stage personally, and writes and maintains the guides published on this site. Where a case proceeds, it is run by a solicitor throughout and counsel is instructed as the case requires.

What we do

We act for patients and families in clinical negligence claims arising from care in HSE and voluntary hospitals, private hospitals, general practice, pharmacies and nursing homes. The types of claim we most often see are set out on our types of claim page and include:

• Birth injuries, including cerebral palsy and Erb's palsy
• A&E negligence: missed fractures, missed diagnoses and premature discharge
• Medication and prescribing errors
• Delayed and missed diagnosis, particularly cancer and sepsis
• Surgical and post-operative negligence
• Cauda equina syndrome and other spinal emergencies
• GP negligence and nursing home negligence
• Fatal claims under the Civil Liability Act 1961

How we work

An honest first view

Not every poor outcome is negligence, and not every case of negligence is worth the cost and strain of litigation. We will tell you at the outset if we think the facts do not support a claim, or if the likely value does not justify proceedings.

Evidence before proceedings

Clinical negligence claims stand or fall on independent expert evidence. We obtain the complete records, identify the right discipline of expert, and do not issue proceedings without a supportive report on both breach of duty and causation.

Clear funding terms

The basis on which costs will be charged, and how outlays such as expert reports are handled, is set out in writing before any work starts, as required by section 150 of the Legal Services Regulation Act 2015.

Accessible

Appointments are available in Dublin, in Kilkenny, by phone and by video, including outside normal office hours where needed. Most of the work in a medical negligence case is done by correspondence, so your solicitor does not need to be local to you.
